Workers' Compensation Appeals
A new process for dealing with Appeals against Review Decisions of the Workers' Compensation Regulator will commence in the Queensland Industrial Relations Commission (Commission) on 1 October 2015.
Here are two scenarios demonstrating how to complete the Appellant and Respondent Statement of Facts and Contentions Forms.
- One dealing with a physical injury (the Mark Winter scenario).
- One dealing with a psychiatric/psychological injury (the Sharon Smith scenario).
It is strongly recommended you carefully review the examples above before making your application.
The Appellant and Respondent's Statements of Facts and Contentions are provided as a guide to assist both Appellants and the Workers' Compensation Regulator in preparing their own Statement of Facts and Contentions. It will be essential that all Appellants issue Third Party Notices of Disclosure shortly after filing the Notice of Appeal so that their Statement of Facts and Contentions are correct when filed. It is important to note that you will be bound by your Statement of Facts and Contentions.
